Idaho Auto Insurance Laws

All licensed drivers in Idaho are required by law to carry liability auto insurance for their vehicles. Drivers who fail to obtain insurance cannot legally drive in the state. While coverage beyond that of bodily injury is not required, additional coverage for auto damage is permitted.

    • Insurance carriers will provide different premiums or rates and different coverage options based upon several factors. Typically younger drivers with a less established driving history and those who have been involved in accidents in the past will have higher premiums. Rates will also vary depending on the type of vehicle the driver owns and other risk factors.

    Failure to Provide Proof of Insurance

    • When a driver is pulled over for a routine traffic stop or any other reason, authorities will ask for proof of liability insurance. Drivers should keep a copy of their policy in their vehicles at all times. Drivers who fail to show proof of insurance will be issued a citation and may be required to pay a fine.

    Rights of the Insurance Carrier

    • Insurance carriers providing auto insurance for drivers have rights with regard to their policies under Idaho law. A policy may be canceled at any time by the carrier after an accident where property damage or bodily injury occurs. The carrier also has the right to settle any claim covered by the policy following an accident if the settlement is made in good faith. A policy may also state that the driver may be required to reimburse the carrier for funds advanced which is not otherwise included in the policy.
